The painful and tragic story of Kashmiri Pandits is not hidden from any one in the world and how this peace loving and patriotic micro minority community of Kashmir was forced at gun point to leave their thousand years old ancestral homes and hearths in 1990 is a million dollar question. They were wipped out completely from their roots and made homesslese under a well thought out plan by Pakistan sponsored terrorists, islamic fundamentalits and some political parties who were rolling the roast in valley during the top militancy period in 1990 and were seeking freedom from India which ultimately proved to be a futile exercise.
It is pertinent to mention here that more than five lack Kashmiri Pandits are out of Kashmir valley for last more than thirty seven years and living a miserable life in camps and non camps in Jammu and other parts of the country. They are presently facing tough challanges in their lives in forceful exile for their survival. One of the most tough and serious challange, this community is facing presently is reterival and restoration of their ancestral lands and temples illegally encroached and occupied by land mafia in Kashmir Valley who soon after the forceful migration illegally grabbed and encroached these lands under the active support of politicians and District administration.
It is important to remind all that an immovable Migrant Property Act 1997 was passed in the Assembly in 1996 to safeguard, protect and preserve this immovable migrant property of Kashmiri Pandits worth crores and concerned Deputy commissioner of Kashmir were made its custodian under this legislation which proved to be a big blunder because they have totally failed to preserve, Protect and restore the illegally encroached and illegally occupied land from encroachers till date rather have and are facilitating the illegal occupation of migrant lands at the Tehsil level with a particular mind set despite passing more than thirty seven years.
There is a big Nexus between land grabbers and field agency of revenue department who have and are facilitating these illegal land grabbings which is a serious matter and a multi crore scam that needs a thorough investigation.
Kashmiri Pandits are running from pillar to post for the restoration of their ancestral illegally occupied lands in Kashmir in different courts but there is no say to their woes and worries at any end. It appears that the Nexus is so deep that they think no body is going to touch them or harm them. The Custodians have badly failed in implementing this immovable Migrant Property Act 1997 at the ground due to corrupt and communal mindset. In this way thousand kanals of migrant land in several Districts of Kashmir still continue to be in the illegal occupation of the land encroachers and even land records at many places in Kashmir of migrant lands have been tempered illegally just to benefit the land mafia by the revenue Department with a derailed mind set that still exists in the system.
It is important to say that any representation /application or any exercise made by the rightful owners of the migrant land in kashmir yield presently no result due to total non seriousness and non coperation of the lower revenue department, the custodian of the migrant property and every exercise of rightful owners of land becomes only a source of earning for them without providing any solace to the aggrevied migrant. The immovable migrant property act has now become totally defunct and no revenue official bothers to adopt it legally or officially. This all has put poor hapless kashmiri Pandits in a big trouble that needs a tangible action and high level enquiry to look into the irregularities in this big land scam that took place under the nose of the Custodians.

Many notable and renowned social activist and leaders of Kashmiri Pandit community are raising this serious issue through print and electronic media before the Governent of Jammu and Kadhmir and Union Government time timely but no serious and concrete action seems to have to been taken in this direction till now to seek accountibilty from these Custodians under whose nose these illegal occupations took place and they did nothing but watched it as a mute spectator which is matter of serious concern. Every one knows that any act passed on the floor of Assembly or Parliament becomes a legislation and has to be followed in true letter and spirit but it is seen first time in the history that any law like immovable migrant property law 1997 has been deliberately made defunct and non accountable by the Custodians and has lost its sheen.
Kashmiri Pandits seek justice for their lands in Kashmir by making immovable Migrant Property Act 1997 vibrant, accountable, accessible, result oriented with the plea to assign the whole job to any other agency except revenue that has badly failed to yield any rich result so far.
Kashmiri Pandit social activist, leaders, philanthropist and intellectuals need to come forward with one voice and vigorously raise this issue at every platform till the illegally occupied lands, temples and shrines are retrieved and handed over to the rightful owners as United we stand divided we fall. A high level enquiry on migrant land scam is also the paramount need of the hour to unearthen this multi crore scam that is and has taken place under the nose of the Custodians. Kashmiri Pandits appeal to Prime Minister of India, Home Minister and Lt. Governor Jammu and Kashmir to come to the rescue of Kashmiri Pandits whose immovable properties are under the illegal occupation of land grabbers in Kashmir and order a high level enquiry in this land scam to bring culprits to the justice.
