Kashmiri Pandit's Land encroachment issue | Immovable Migrant property Act failed | Distress sale act an eye wash | High level probe demanded
As every body knows that despite passing more than three decades and consistent hectic struggle of displaced Kashmiri community, their ancestral land encroachment issues despite passing more than 37 years in exile, are still as they were in 1990 but they are struggling hard to seek back their encroached land and their roots in Valley.
As we all know that immovable Migrant property Act failed badly & Distress sale act become now an eye wash for KPs but still they demand that High level probe on account of restoration and retrieval of their ancestral immovable properties that was left back in valley in 1990 after their forceful exodus at the hands of islamic terrorists and Pakistan sponsored sympathizers that appears to be still far away from their real dream be restored to them at any cost which is their right.
The displaced migrant community faced total non cooperation, non compliance and non seriousness on behalf of the custodian staff who were entrusted the job of working as custodians under immovable Migrant Property Act 1997 as custodians they were supposed to restore, retrieve the illegally occupied lands of temples, shrines and of general land of kashmiri pandits and work as its custodian but that seemed to be far away from Dispalced community's expectations.
It is very important to mention here that most of the kashmiri Pandits have been deliberately kept engaged in several litigations in valley in various courts of law of Revenue and judiciary in these thirty seven years and no tangible action for restoration have been taken so far but what kashmiri Pandits get there in Valley is " Tarikh Pe Tarikh". It is very suprising that in the migrant land grabbing and illegal encroachment cases, some politicians, beaurocrats and revenue officials are actively involved as either they did not act on their land issues due to communal approach or due to corrupt or personal interests. But at the end it is poor Kashmiri Pandit who is facing the brunt of injustice and financial constraints every time in these thirty seven years.
It is also worthwhile to mention here that a few years ago a Government migrant grievience portal was launched by the Lt. Governor of Union Territory of J&K and a lot of land was restored and retrieved by the Deputy Commssioners of valley which was widely appreciated but unfortunately this portal was made defunct deliberately and the momentum was derailed and defuncted by some Balck sheeps in the system and threw all winds on the expectations of poor Dispalced Kashmiri Pandits living in exodus.
The community can not remain a mute spectator on this grave issue despite struggling hard for 37 years without any dividend and the most annoying issue is that at most of places in rural as well as urban area in kashmir , the land records of migrant lands have been tampered with evil intention to benefit a particular section of the society which is an alarming situation for the kashmiri pandits and it demands a high level probe to unearthen this multicrore scam which will surely bring to justice big fishes in the well.
As far as the role of Custodians are concerned, it has been seen in these thirty seven years, their role in this direction is lukeworm and the ground staff is totally biased and don't bother to act on the land complaints of kashmiri Pandits due to unaccountability at the highest revenue offices which was envisaged in the immovable Migrant property law 1997 or because there can also be the other reason like corruption and working hand in glove with the encroachers or land Mafia for their personal interests and with communal mindset
Conclude :
Since this immovable Migrant act did not bring any any expected result or any solace for this Dispalced community at large in these thirty seven years and huge bubglings and scams took place on their name under the nose of this act, it is now the high time to go for a high level probe into this historical land scam where miracles will surface and come into limelight .
More than seven Lakh kashmiri Pandits who were thrown out of Kashmiri Valley in 1989 due to Pakistan Sponsored terrorists and anti social elements of Kashmir when the terrorism was at its peak. They had to leave every thing including immovable property worth crores which was immediately encroached and illegally grabbed under a well though out machination after their migration.
But despite passing more than 37 years of their in exile, most of their ancestral land is still under the illegal occupation of land grabbers and land Mafia despite a law namely immovable Migrant property act 1997 which was brought in place by legislative Assembly to safe guard, protect, preserve and retrieve the illegally occupied Migrant land whose sole custodians were made concerned Deputy Commissioner but still thousand kanals of land still continue to be under the illegal occupation and in their clutches.
It is over all the general aspiration of seven lakh Kashmiri Pandits that a high level investigating team be constituted under the supervision of two sitting judges of Hon'ble High Court to unearthen this scam that has rendered poor Kashmiri Migrants in pathetic and miserable position. The concerned Deputy commissioners can still act honestly and discharge their assigned role in a befitting manner to provide justice to this affected community but they are still in deep slumber.
